2. Eligibility & Account Registration
2.1 Age Requirement
You must be at least 16 years old to use YellowPin. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
2.2 Account Creation
To access certain features, you may need to create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
2.3 Account Responsibility
You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.
3. Platform Usage Rules
3.1 Permitted Use
YellowPin is designed to connect job seekers with employers, training providers, and educational opportunities. You agree to use the Platform only for lawful purposes and in accordance with these Terms.
3.2 Prohibited Activities
You agree NOT to:
- Use the Platform for spam, phishing, or fraudulent activities
- Post false, misleading, or deceptive job listings or profiles
- Harass, discriminate against, or abuse other users
- Scrape, crawl, or automate access to the Platform without permission
- Interfere with the Platform's security, servers, or networks
- Impersonate any person or entity or misrepresent your affiliation
- Upload viruses, malware, or any harmful code
- Use the Platform for illegal recruitment practices or human trafficking
3.3 Content Guidelines
Any content you post (resumes, profiles, messages, reviews) must:
- Be accurate, truthful, and not misleading
- Respect intellectual property rights of others
- Not contain hate speech, harassment, or explicit content
- Comply with applicable laws and regulations
4. For Job Seekers
4.1 Profile Accuracy
You are responsible for ensuring that your profile, resume, and application materials are accurate and up-to-date. Misrepresentation may result in account suspension.
4.2 Application Process
When you apply for a position through YellowPin:
- Your application and profile may be shared with the respective employer
- Employers may contact you directly via the Platform or provided contact details
- YellowPin is not a party to any employment agreement between you and an employer
- We do not guarantee job placement, interview selection, or employment outcomes
4.3 Communication Consent
By using YellowPin, you consent to receive communications from employers, training providers, and YellowPin regarding job opportunities, application updates, and platform notifications. You may manage preferences in your account settings.
5. For Employers & Partners
5.1 Verification
Employers, educational institutions, and training providers may be required to verify their business credentials before posting opportunities. We reserve the right to reject or remove unverified listings.
5.2 Job Posting Guidelines
All job postings must:
- Comply with applicable labor laws and anti-discrimination regulations
- Clearly state job title, responsibilities, location, and compensation (if applicable)
- Not contain false, misleading, or deceptive information
- Respect candidate privacy and data protection requirements
5.3 Recruitment Responsibility
YellowPin serves as a connection platform only. We are not responsible for:
- The hiring decisions, interview processes, or employment terms offered by employers
- Disputes between job seekers and employers
- Verifying the accuracy of employer-provided information beyond basic checks
6. Intellectual Property Rights
6.1 Our Content
All content on YellowPin, including logos, designs, text, graphics, software, and the selection/arrangement thereof, is owned by YellowPin or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
6.2 Your Content
By uploading content (resumes, profiles, messages) to YellowPin, you grant us a non-exclusive, worldwide, royalty-free license to:
- Store, display, and transmit your content on the Platform
- Share your profile with employers or partners you apply to
- Use anonymized, aggregated data for platform improvement and analytics
You retain ownership of your content and may request deletion subject to our Privacy Policy.
7. Fees & Payments
YellowPin offers both free and premium features. If you choose to purchase premium services:
- All fees are listed in Indian Rupees (₹) and are non-refundable unless required by law
- Payments are processed through secure third-party gateways
- Subscriptions auto-renew unless cancelled before the renewal date
- We reserve the right to modify pricing with 30 days' notice
Free users may access basic job search and application features. Premium features may include enhanced visibility, priority support, or advanced analytics.
8. Disclaimers & Limitation of Liability
8.1 "As Is" Basis
The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or harmful components.
8.2 No Employment Guarantee
YellowPin is a connection platform. We do not guarantee:
- That you will receive job offers, interviews, or employment
- The accuracy, legitimacy, or quality of job postings or employer profiles
- The outcome of any application, interview, or hiring process
8.3 Limitation of Liability
To the maximum extent permitted by law, YellowPin and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or opportunities, arising from your use of the Platform.
Our total liability for any claim related to these Terms or the Platform shall not exceed the amount you paid to YellowPin in the 12 months preceding the claim, or ₹1,000 if you used free services.
9. Indemnification
You agree to indemnify, defend, and hold harmless YellowPin, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Platform in violation of these Terms
- Your content or communications with other users
- Your interaction with employers, job seekers, or third parties through the Platform
- Your violation of any third-party rights or applicable laws
10. Termination & Suspension
We reserve the right to suspend or terminate your account or access to the Platform at any time, with or without notice, for reasons including:
- Violation of these Terms or our Privacy Policy
- Fraudulent, abusive, or illegal activity
- Prolonged inactivity (12+ months)
- Request by law enforcement or regulatory authorities
Upon termination, your right to use the Platform ceases immediately. Provisions regarding intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination.
11. Modifications to Terms
We may update these Terms from time to time. If we make material changes, we will:
- Post the revised Terms on this page with an updated "Last Updated" date
- Notify registered users via email or in-app notification
- Require affirmative acceptance for significant changes (where applicable)
Your continued use of YellowPin after changes take effect constitutes acceptance of the revised Terms. Please review these Terms periodically.
12. Governing Law & Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
12.2 Dispute Resolution
Any dispute arising from these Terms or your use of YellowPin shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of courts in Pune, Maharashtra, India.
12.3 Class Action Waiver
You agree that any claim or dispute shall be resolved on an individual basis, and you waive any right to participate in class actions, class arbitrations, or representative proceedings.
13. Miscellaneous
13.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms posted on the Platform, constitute the entire agreement between you and YellowPin regarding the subject matter herein.
13.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
13.3 Assignment
You may not assign or transfer these Terms without our prior written consent. YellowPin may assign these Terms in connection with a merger, acquisition, or sale of assets.
13.4 No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless expressly acknowledged in writing.
